1ST RESPONSE PLUMBING, INC.

Terms and Conditions

Clear terms for our digital services, service requests, payments, and operational messages.

Effective date: September 30, 2026

1. Scope and acceptance

These Terms and Conditions govern use of the websites, employee portal, mobile app, and related digital services operated by 1st Response Plumbing, Inc. By using these services, you agree to these terms to the extent permitted by applicable law. If you do not agree, discontinue use and contact us by telephone for assistance. You must be an adult with authority to request the service or an authorized user acting for your employer or property owner.

These terms do not replace a signed estimate, service agreement, construction contract, warranty, employment agreement, or separately accepted mobile-app terms. A specific signed agreement controls a conflict concerning its subject matter. Our Privacy Policy explains how information is handled. Acceptance of these terms is not consent to receive SMS messages.

2. Requests, appointments, and property access

Submitting a request does not guarantee an appointment, technician availability, a particular arrival time, or acceptance of a job. Appointments and the scope of work must be confirmed by our team. Arrival estimates may change because of traffic, weather, prior jobs, access restrictions, or safety conditions.

Provide accurate contact and property details and disclose known hazards, access requirements, and authorization limits. You are responsible for obtaining permission from the owner or other authorized party for requested work. We may reschedule or decline work when access, authorization, safety, or other necessary conditions are not met.

Emergency plumbing requests are accepted 24/7; immediate dispatch is subject to availability. Online forms, email, and SMS are not emergency-response systems. Call (954) 588-7957 for urgent plumbing assistance. For immediate danger, suspected gas leaks, fire, or a medical emergency, contact 911 or the appropriate utility emergency service.

3. Estimates, changes, and cancellations

An estimate describes the proposed scope, assumptions, price, and any stated expiration or conditions. Hidden conditions, changed quantities, additional work, permits, or customer-requested changes may require a revised estimate or change order. Website descriptions and automated calculations are general information and do not establish a binding price or scope.

Charges, deposits, cancellation fees, payment schedules, and warranties apply only as disclosed in the relevant agreement or otherwise permitted by law. Contact the office promptly to cancel or reschedule. Nothing here imposes an undisclosed fee or overrides a cancellation right provided by law.

4. Invoices and payments

Review the invoice, amount, and payment method before authorizing payment. Pay according to the due date and terms on your invoice or agreement. A payment method may be offered through Stripe or another supported provider, whose terms and eligibility rules may also apply. Financing, when offered, is subject to the provider's approval and disclosures.

Payment authorization and final settlement are different stages. If a payment appears pending or the invoice has not updated, contact us and check the existing transaction before trying again. Do not intentionally submit duplicate payments. Contact the office with your invoice number about billing errors, receipts, refunds, or payment disputes. Any refund is handled under the applicable agreement and law; these terms do not remove statutory or cardholder dispute rights.

5. Tap to Pay on iPhone

Authorized technicians may use Tap to Pay on a compatible iPhone through our supported payment provider to accept contactless payments. Availability depends on the device, operating system, account eligibility, network connection, provider configuration, and required Apple permissions. Separate Apple and payment-provider terms apply where presented; accepting these terms does not replace those agreements.

Technicians must use their assigned account, confirm the correct customer and invoice, show or explain the amount, and obtain the cardholder's authorization before collecting payment. Customers should follow the secure on-screen instructions and keep PIN entry private. Technicians must never record, photograph, or request disclosure of a customer's PIN or card security code.

A connected reader or card tap alone does not establish that an invoice is paid. Verify the payment result and invoice status before retrying or giving a paid receipt. If the status is uncertain, contact the office. Use an alternative approved payment method if Tap to Pay is unavailable; never bypass device or payment-provider security controls.

6. SMS messaging terms

Program name: 1st Response Plumbing, Inc. Service and Dispatch Alerts. Messages may include customer appointment reminders, technician arrival estimates, service and billing updates, and technician work-order assignments, dispatch alerts, and schedule changes. Enrollment applies only to the categories disclosed when consent is obtained. Operational consent does not authorize promotional messaging.

Participation is voluntary and requires your affirmative consent for the relevant program. You must control the mobile number you provide and notify us if it changes. A phone number on a service request or staff record, employment status, and acceptance of general terms do not by themselves authorize recurring texts. Contact the office for available enrollment methods or alternative ways to receive updates. Consent is not a condition of purchasing plumbing services.

Message frequency varies with your service requests, appointments, account activity, or assigned work. Message and data rates may apply. Your wireless provider's charges and terms apply. Messages may be automated. Delivery is not guaranteed, and carriers are not liable for delayed or undelivered messages. Do not rely on SMS for emergencies or time-critical safety instructions.

To unsubscribe, reply STOP to the number sending the messages. You may receive one final opt-out confirmation; further program messages stop unless you provide new consent. You may also contact the office to request removal. Unsubscribing does not cancel an appointment, invoice, or work assignment. Arrange an alternative communication method when needed.

For help, reply HELP, call (954) 588-7957, email 1st.responseplumb@gmail.com, or visit our Support page. For details about mobile information and consent data, see our Privacy Policy. No mobile information is shared with third parties or affiliates for their marketing or promotional purposes.

7. Accounts and authorized team use

Keep account details accurate and credentials confidential. Do not share staff accounts, impersonate another user, access records outside your role, or use customer information for personal purposes. Notify the office promptly if a device is lost or an account may be compromised. Access may be limited or suspended to protect records, investigate misuse, or reflect changes in authorization.

Technicians and other staff must accurately record assignments, work status, time, approvals, and payment activity, and follow company procedures. Use travel and location features only for authorized work. Do not operate the app while driving. These digital-service terms do not create an employment contract or alter applicable employee rights.

8. Uploaded content and acceptable use

Upload only material you are authorized to provide. You retain your rights in submitted material and authorize us and our service providers to use it as needed to perform the requested service, document the work, administer your account, and meet legal obligations. Publishing job photographs for unrelated promotion requires an appropriate separate basis or permission.

Do not upload unlawful content, malware, unrelated sensitive records, or material that infringes another person's rights. Do not attempt to bypass security, scrape private records, disrupt services, or misrepresent approvals or transactions. Our branding, original website content, and software are protected by applicable intellectual-property laws; these terms grant only the access needed for authorized use.

9. Availability, third parties, and limitations

Digital services may be interrupted by maintenance, connectivity problems, provider outages, or other events. We do not promise uninterrupted or error-free operation. General website information is not a substitute for an on-site diagnosis, approved project documents, or professional advice specific to your property. External links are provided for convenience and do not make us responsible for another provider's services or policies.

To the extent permitted by law, digital services and general informational content are provided as available without additional implied warranties. Nothing in these terms excludes liability or rights that cannot lawfully be excluded, limits remedies under an applicable service warranty, or excuses fraud, willful misconduct, or other liability that applicable law preserves.

10. Questions, governing law, and updates

Please contact the office first so we can investigate service or account concerns. Florida law governs these terms, subject to applicable federal law and any mandatory protections that apply to you. These terms do not require arbitration or waive access to small-claims court, regulatory agencies, or other rights provided by law.

We may update these terms by posting a revised version and effective date. Material changes will be communicated or separately accepted where required. Updates do not retroactively change an already signed service agreement. If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law.
